This is the Smart Goal Academy Legal Protection Package — Ontario Compliance Review.

By signing the Master Acknowledgment (Section 14), the parent/guardian enters into a contractual agreement with Smart Goal Academy for the provision of the services described above, on the terms set out in this Package.
1.5 Consumer Agreement Disclosure
Currency: All amounts in this Package are Canadian dollars (CAD).
Additional Charges: No additional mandatory charge applies unless expressly disclosed in this Package or separately agreed in writing before it is incurred. Optional products, events, tournaments, camps, uniforms, travel, or third-party services are not included unless expressly stated.
Terms and Methods of Payment: Payment may be made by a method accepted by SGA and communicated at registration. Due dates are set out in Section 8. No recurring charge or renewal is authorized beyond the selected commitment unless separately authorized by the parent/guardian.
Performance Period: Services commence on the applicable registration/start date and end on June 11, 2027, unless the selected Monthly Flex or 3-Month Plan ends earlier under Section 8.
Place and Method of Performance: Services are delivered in person at SGA-designated municipal parks, school fields, gymnasiums, community centres, or other approved training venues in Vaughan, Ontario. Exact venue assignments and schedule changes are communicated to families. Coaching is delivered by SGA coaches, instructors, staff, or authorized contractors under SGA program standards.
Cancellation / Refund Rights: Contractual cancellation and refund terms are in Section 8. Those terms do not limit any non-waivable right or remedy under applicable consumer-protection legislation.

Informed Consent & Assumption of Risk
PLEASE READ THIS SECTION CAREFULLY.
2.1 Nature of Activities
The program operates from September 20, 2026 – June 11, 2027. It includes outdoor and indoor soccer and futsal training, parent-child sessions (for U4), technical and tactical drills, small-sided games, scrimmages, physical fitness exercises, and related activities. Activities take place outdoors at municipal parks and school fields and indoors at gymnasiums and community centres in the City of Vaughan, Ontario.
For U4 participants (ages 3–4), a parent or guardian must remain present at the training venue for the entire duration of each session.
2.2 Acknowledgment of Inherent Risks
I acknowledge that participation in soccer and athletic training involves inherent risks that cannot be fully eliminated regardless of the care taken, including but not limited to:
Outdoor Risks: Physical contact, collisions, falls on natural grass, artificial turf, or uneven terrain; heat-related illness, sunburn, weather exposure including thunderstorms and lightning; insect bites and stings, environmental allergens, and other outdoor hazards.
Indoor Risks: Collisions with walls, goal posts, gymnasium equipment, bleachers, or pillars; falls on indoor surfaces; ball impact at close range in confined spaces; indoor air quality, ventilation limitations, and wet surfaces near entrances during winter.
Year-Round Risks: Muscle strains, sprains, fractures, ligament injuries, dental injuries, and concussions; communicable illness, including COVID-19 and other respiratory infections; emotional distress or anxiety associated with competitive or group activities; travel to and from training venues in adverse weather.
Additional Considerations for U4 (Ages 3–4): Developmental variability in motor skills, coordination, and attention span; separation anxiety or emotional distress; toileting needs remain parent's responsibility; greater vulnerability to temperature extremes, dehydration, and fatigue.
2.3 Voluntary Assumption of Risk
I voluntarily assume all inherent risks associated with my child's participation, including those described above and any risks not specifically identified. I confirm that my child is physically able to participate and that I have disclosed all relevant medical and health information.
2.4 Consent to Participation
I consent to my child's participation in the Smart Goal Academy program described in Section 1, having been informed of the nature of the activities and the inherent risks involved.

Parent/Guardian Release of Liability
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
3.1 Release of Parent's/Guardian's Own Claims
To the fullest extent permitted by applicable law, I, in my own personal capacity (not on behalf of my child), hereby release, waive, and discharge: Smart Goal Academy and its directors, officers, employees, coaches, instructors, volunteers, agents, and independent contractors; the City of Vaughan, its employees, agents, and facility operators; any facility owner, landlord, or property manager (collectively, the "Released Parties") from any and all claims that I personally may have arising out of or in connection with my child's participation in the program, including claims arising from the ordinary negligence of the Released Parties.
3.2 Indemnification
I agree to indemnify and hold harmless the Released Parties from claims, damages, losses, and costs (including reasonable legal fees) arising from: my own acts or omissions in connection with my child's participation; materially false or incomplete information provided by me in this Package; my breach of any obligation set out in this Package — to the extent permitted by applicable law.
3.3 Limitation of Release
This release does not apply to claims arising from: gross negligence or wilful misconduct by any of the Released Parties; reckless disregard for participant safety; physical, sexual, or emotional abuse.
3.4 Preservation of Minor's Rights
Nothing in this Agreement is intended to waive, release, compromise, or otherwise limit any right or claim of the minor participant that a parent or guardian cannot lawfully waive, release, compromise, or limit under applicable law.
3.5 General Limitation
Nothing in this Agreement excludes or limits liability to the extent such liability cannot lawfully be excluded or limited under applicable law.
3.6 Emergency Medical Authorization
I authorize Smart Goal Academy to take all reasonable steps to secure emergency medical care for my child, including calling 911 and authorizing necessary treatment. I accept responsibility for costs not covered by OHIP or private insurance.
3.7 Governing Law
This Agreement is governed by the laws of the Province of Ontario and the applicable laws of Canada. The parties submit to the exclusive jurisdiction of the courts of Ontario. If any provision is found unenforceable, the remaining provisions continue in full force.

Please provide two emergency contacts, family physician information (optional), and any medical conditions SGA reasonably needs to know to support safe participation.
4.4 Medication Administration
SGA does not routinely administer medication to participants. Where medication administration during training is required, parents/guardians must contact the Head Coach to discuss individual arrangements in accordance with SGA's Medication Administration Policy. Emergency medications (EpiPen, rescue inhaler) must be provided to the designated coach in original packaging with the participant's name clearly marked.
I confirm that all information provided above is true and complete. I understand that failure to disclose relevant medical information may limit SGA's ability to provide appropriate care and may endanger my child.

Concussion Protocol — Rowan's Law Compliance
Pursuant to Rowan's Law (Concussion Safety), 2018, S.O. 2018, c. 1 and Ontario Regulation 161/19.
5.1 Concussion Awareness Resource Confirmation
I confirm that, before registration and within the previous 12 months, I have reviewed the applicable Ontario Concussion Awareness Resource, as required where Rowan's Law and Ontario Regulation 161/19 apply.
Where required by Rowan's Law and Ontario Regulation 161/19, the participant also confirms that they have reviewed the applicable age-appropriate Ontario Concussion Awareness Resource within the previous 12 months.
5.2 SGA Concussion Code of Conduct — statutory commitments:
• Fair play and respect for participants, coaches, officials, staff, and opponents.
• Recognition and reporting of possible concussion symptoms, including self-reporting and reporting to SGA's Designated Person when another athlete may have sustained a concussion.
• Return-to-sport: supporting and complying with the graduated Return-to-Sport process.
• Information sharing about a removal from sport or diagnosed concussion with the athlete's school and every other sport organization with which the athlete is registered.
• Coach discussion opportunities before and after training, practice, and competition.
• High-risk prohibited play compliance where SGA adopts a zero-tolerance or mandatory-expulsion rule.
As a condition of participation, I agree to: immediately report any suspected concussion symptoms; support immediate removal from activity when a concussion is suspected; refrain from pressuring coaching staff to return my child prematurely; comply fully with SGA's Return-to-Sport Protocol; promptly inform SGA of any concussion diagnosis, treatment, or medical clearance.
5.3 Removal-from-Sport Protocol
Designated Person: For each SGA activity, the Head Coach or another adult expressly designated by SGA is the "Designated Person" responsible for administering the removal-from-sport and return-to-sport protocols. A Designated Person must remove an athlete from further training, practice, or competition whenever SGA becomes aware that the athlete has sustained or is suspected of having sustained a concussion, whether or not the suspected concussion occurred during an SGA activity. SGA will make and securely retain a record of every incident in which an athlete is removed because of a suspected concussion. When an athlete is removed, the Designated Person will advise the athlete and, if the athlete is under 18, the parent/guardian that a medical assessment by a physician or nurse practitioner is required before return in accordance with SGA's Return-to-Sport Protocol. The Designated Person will ensure that the athlete/parent receives SGA's Removal-from-Sport and Return-to-Sport Protocols as soon as practicable after removal.
Any participant suspected of having sustained a concussion during any SGA activity will be: immediately removed from the activity; not permitted to return to any physical activity for the remainder of that session; monitored by coaching staff until released to a parent/guardian or emergency contact; provided with a written Concussion Incident Report to take to their healthcare provider.
5.4 Return-to-Sport Protocol
The athlete or parent/guardian must share with the Designated Person any medical advice or recommendations relevant to return. If the athlete is medically assessed and not diagnosed with a concussion, return is permitted only after the athlete/parent provides the Designated Person with confirmation of the assessment and medical clearance to return. If a concussion is diagnosed, the athlete must progress through SGA's graduated return-to-sport steps and may not return to unrestricted training, practice, or competition until the required medical clearance is provided. The Designated Person will remind an athlete diagnosed with concussion, or the parent/guardian of a minor athlete, of the importance of disclosing the diagnosis to the athlete's school and every other sport organization with which the athlete is registered. SGA will make and securely retain a record of the athlete's progression through the graduated return-to-sport steps until the required medical clearance is provided.
A participant removed under Section 5.3 may return only in accordance with Rowan's Law, Ontario Regulation 161/19, and SGA's Return-to-Sport Protocol. If a physician or nurse practitioner determines that the participant did not sustain a concussion, return may occur in accordance with the written medical assessment. If a concussion is diagnosed, the participant must complete the applicable graduated return-to-sport stages and obtain any medical clearance required by law before resuming unrestricted training, practice, or competition. All required documentation must be submitted to and reviewed by the Head Coach or designated SGA representative.
5.6 Concussion Information Privacy
Personal information collected through SGA's removal-from-sport and return-to-sport protocols will be limited to what is reasonably necessary to administer those protocols. Access will be limited to persons who require the information to perform their duties. Records will be retained, disclosed, and disposed of securely in accordance with Section 9 and applicable law.

Code of Conduct
6.1 Participant Expectations
Treat all coaches, staff, volunteers, and participants with respect, dignity, and fairness. No bullying, harassment, discrimination, intimidation, aggression, or abusive language. Follow all safety instructions and training rules. Use all equipment and facilities safely. No prohibited items (weapons, drugs, alcohol, tobacco/vaping). Wear appropriate footwear: cleats for outdoor; non-marking soles for indoor. Shin guards mandatory for match-play (U6+). Soft-soled athletic shoes acceptable for U4. Good sportsmanship, fair play, and positive attitude. No unauthorized use of mobile phones or recording devices during sessions.
6.2 Anti-Harassment & Discrimination
Zero-tolerance policy consistent with the Ontario Human Rights Code, R.S.O. 1990, c. H.19.
6.3 Parent/Guardian Conduct
Parents and guardians must conduct themselves respectfully toward all staff, coaches, volunteers, and other families. Abusive, threatening, or disruptive behaviour may result in the participant's removal from the program.
6.4 Disciplinary Procedure
Violations of this Code may result in: verbal warning and discussion with participant; temporary removal from activity; contact with parent/guardian for immediate pickup; suspension from upcoming sessions (for suspensions exceeding two (2) weeks, SGA will provide a written decision with reasons); permanent dismissal from the program (only after a written decision with reasons, except where immediate removal is necessary to protect the safety of participants or staff).
Where a participant is suspended or dismissed, SGA will consider a reasonable credit or pro-rated refund for the unused portion of any pre-paid fees, except where dismissal results from serious misconduct, violence, abuse, or Safe Sport violations.

Safe Sport Policy
Smart Goal Academy is committed to providing a safe, inclusive, and respectful environment for all participants, families, coaches, and staff. This policy applies to all SGA activities.
7.1 Rule of Two
No SGA coach, volunteer, or staff member shall be alone with a minor participant in a private or closed setting. A minimum of two screened adults, or one screened adult in an observable and open environment, must be present at all times.
7.2 Screening
All coaches and volunteers who have direct interaction with minor participants are required to hold a current Police Vulnerable Sector Check (PVSC) prior to commencing duties. PVSCs must be renewed every three (3) years.
7.3 Reporting & Complaints
Any participant, parent, coach, or staff member who witnesses or becomes aware of behaviour that may constitute harassment, abuse, maltreatment, or a breach of this Safe Sport Policy should report it to the Head Coach or any member of the Board of Directors. Reports may be made verbally or in writing to info@smartgoal.ca.
SGA will receive, document, triage, and address reports promptly, fairly, and as confidentially as reasonably possible. Depending on the nature of the allegation, SGA may use an independent investigator or decision-maker, refer the matter to a governing sport body, or report it to the appropriate authorities. SGA will not conduct an internal process in a manner that interferes with a police, child-protection, or other legally required investigation.
7.4 Electronic Communication & Social Media
Coaches shall not communicate with minor participants via personal social media, text message, or direct message. All coach-participant communication shall be directed through parents/guardians or through official SGA channels (email, SGA group platforms).
7.5 Change Rooms & Photography
No photography, video recording, or use of mobile devices is permitted in change rooms or washroom facilities. Coaches shall not enter change rooms occupied by participants of the opposite gender unless accompanied by a same-gender adult or in an emergency.
7.6 Physical Contact
Physical contact with participants is limited to that which is necessary for instruction, demonstration, safety, or injury response. Contact must be appropriate to the situation, brief, and in an open and observable setting.

Program Fees & Payment Options
The Smart Goal Academy Fall/Winter Season runs from September 20, 2026 to June 11, 2027.
8.1 What's Included
Two training sessions per week; one weekly Game Day; player assessment and progress monitoring throughout the season.
8.2 Payment Options
Option 1: Full Season Plan — $2,800 total, payable before the participant's first regular session unless otherwise agreed in writing. One payment for the entire season. Best-value option; guarantees your child's place for the full season.
Option 2: 3-Month Plan — $1,050 per period ($3,150 total if all three periods are purchased). Each period is payable before that period begins. The season is divided into three 3-month periods. Your child's place is secured for each fully paid period.
Option 3: Monthly Flex Plan — $375 per paid month. There is no obligation to purchase subsequent months. Your child's place is reserved for the paid month. To guarantee a place for the following month, payment must be received by the 20th of the current month. After this date, enrollment is subject to availability.
8.3 Sibling Discount
10% discount for each additional sibling enrolled in the same season, applied to whichever plan the family selects, beginning with the second child.
8.4 Joining Mid-Season
New players welcome throughout the year, subject to availability. Children joining mid-month may be offered an Adaptation Period before moving into a regular plan. All remaining fees follow the same pricing structure. Every new player is welcome to attend a FREE TRIAL SESSION before registration.
8.5 Cancellation & Refund
Full Season Plan: 30+ days before season start — full refund less $75 admin fee; 14–29 days — 50% refund; less than 14 days — no refund. 3-Month Plan: no refund for a period already commenced; no further payments due upon cancellation before the next period. Monthly Flex Plan: no refund for a month commenced; discontinue by not paying by the 20th. Medical withdrawal (physician's letter): pro-rated refund may be considered, less $75 admin fee. SGA cancellation: pro-rated refund for remaining unused portion.
Nothing in this Package limits, waives, or contracts out of any cancellation, refund, disclosure, delivery, or other right or remedy available to a consumer under applicable law, including the Consumer Protection Act, 2002 and its regulations, where applicable.

Privacy Policy
Smart Goal Academy is committed to protecting personal information in accordance with applicable Canadian privacy laws and recognized privacy principles.
9.1 Information We Collect
Participant and parent/guardian names, contact information, and date of birth; emergency contact information; medical and health information relevant to safe participation; payment and billing information; photographs and video (with consent); attendance and assessment records.
9.2 Purpose of Collection
Personal information is collected for: program registration and delivery; emergency contact and medical care; communication regarding schedules, locations, and updates; assessment and development tracking; billing and payment processing; compliance with legal obligations.
9.3 Consent
By signing this Package, you consent to the collection, use, and disclosure of personal information for the purposes described above. You may withdraw consent at any time by contacting info@smartgoal.ca, subject to legal or contractual restrictions.
9.4 Limiting Collection & Use
SGA collects only personal information that is reasonably necessary for the purposes identified. Personal information will not be used for purposes other than those for which it was collected without additional consent.
9.5 Disclosure
Personal information is not shared with third parties except: as required for emergency medical care; as required by law (including child protection obligations); with service providers who assist SGA in delivering the program (subject to confidentiality obligations); or with your explicit consent.
9.6 Safeguards
SGA protects personal information using reasonable administrative, technical, and physical safeguards appropriate to the sensitivity of the information. Digital records are stored securely with access limited to authorized personnel.
9.7 Access & Correction
You may request access to, or correction of, your or your child's personal information by contacting info@smartgoal.ca. SGA will respond within 30 calendar days.
9.8 Records Retention
Personal information is retained only as long as reasonably necessary: Registration, waiver, and consent records: seven (7) years after last participation (limitation period considerations). Incident and injury reports: seven (7) years. Medical and emergency contact information: end of the season in which the participant last participated, or as required by an ongoing matter. Payment/billing records: seven (7) years (tax/accounting requirements). Assessment and development records: three (3) years after last participation. Marketing/media consent records: until consent is withdrawn or the retention period for the related content expires. Upon expiry of the applicable retention period, records will be securely destroyed.
9.9 Breach Response
SGA will maintain and respond to privacy/security incidents in accordance with applicable law. Where PIPEDA applies, SGA will keep records of breaches of security safeguards as required and, where it is reasonable to believe that a breach creates a real risk of significant harm, will notify affected individuals and report the breach to the Office of the Privacy Commissioner of Canada as soon as feasible. Where another privacy regime applies, SGA will comply with the corresponding notification, reporting, and record-keeping requirements.

Photo, Video & Media Consent
SGA may photograph or record video of activities. Consent or refusal to consent does not affect the participant's enrollment or participation in the program. Please indicate your consent for each category below.
Where consent is not given, SGA will make reasonable operational efforts not to intentionally feature or identify the participant in SGA-controlled promotional media. Incidental appearance in wide-angle or group-event imagery may not always be preventable, but SGA will not intentionally publish an identifiable close-up of the participant for promotional purposes without consent.

Authorized Pick-Up & Transportation
11.1 Authorized Persons
Participants will only be released to persons listed below. Photo ID will be required for verification. The registering parent/guardian is automatically authorized.
11.2 Temporary Pick-Up Authorization
If an unlisted person needs to collect your child on a specific occasion, the authorized parent/guardian may provide temporary authorization by sending a verified email or text message to the Head Coach or designated staff member before the end of the session, including the temporary person's full name. The temporary person must present photo ID.
11.3 Age-Based Rules
Ages 3–4 (U4): A parent or guardian must remain present for the entire session. Ages 5–12: Released only to an authorized or temporarily authorized adult. No independent departure. Ages 13–16: May be released to authorized third-party transportation or permitted to depart independently only with explicit written consent below.
11.4 Third-Party / Independent Departure Consent (Ages 13–16)
SGA's supervision responsibility ordinarily ends once the participant has been released in accordance with this Policy to an authorized person or, where expressly authorized, permitted to depart independently.

Attendance & Late Pick-Up
12.1 Attendance
Participants are expected to attend scheduled sessions. No refunds or credits for individual missed sessions.
12.2 Late Pick-Up
10-minute grace period after the scheduled end time. After the grace period, a late fee of $1.00 per minute may be applied. If no parent/guardian or emergency contact can be reached within a reasonable time, SGA may contact appropriate authorities where reasonably necessary to protect the participant's safety and welfare. Persistent late pick-ups may result in a discussion with the parent/guardian and, if unresolved, may affect continued enrollment.
Weather & Facility Safety
13.1 Outdoor Sessions (Sep–Nov, Apr–Jun)
Participants should arrive with sunscreen (SPF 30+), water bottle, and hat/cap. Mandatory hydration breaks during outdoor activities. SGA may modify, shorten, relocate, or cancel activities based on temperature, Humidex, air quality, UV conditions, participant age, field conditions, and other relevant safety considerations. Outdoor activities will be immediately suspended during thunderstorms or lightning.
13.2 Indoor Sessions (Nov–Mar)
Non-marking indoor footwear required. Shin guards mandatory for match-play (U6+). Coaches inspect training areas before each session. Sessions may be modified or cancelled due to poor ventilation, excessive heat, or other facility concerns.
13.3 Winter Weather & Cancellations
Training may be cancelled during Environment Canada severe weather warnings, blizzards, ice storms, or extreme cold alerts affecting Vaughan. Cancellations communicated via email and social media as early as reasonably possible. No refunds for individual weather-related cancellations.
13.4 Facility Emergencies
In any facility emergency, participants follow the host facility's emergency procedures. Coaches conduct a headcount at assembly points.
13.5 Illness Policy
No attendance with fever (38°C+), vomiting, diarrhea, or communicable illness symptoms. Ill participants must be picked up within one (1) hour of notification. Return only after 24 hours symptom-free or with medical clearance. SGA follows all applicable York Region Public Health and provincial directives.

• I understand that by signing, I am giving up certain legal rights as described in Sections 2 and 3.
I acknowledge that this Package is Version 3.0. Any material amendment made after signing will be communicated to me and, where additional consent is legally required, will not take effect against me until that consent is obtained.
Nothing in this Package is intended to waive or contract out of any right or remedy that applicable Ontario or Canadian law prohibits the parties from waiving or contracting out of.
